The Greek Council of State plenary stated that a recent law for legalizing unauthorized buildings is constitutional, declaring just one of the law’s provision as unlawful.
The Supreme Court encountered no unconstitutional provisions in the Greek law addressing arbitrary buildings, with the exception of Article 23 stating that properties which have already been declared arbitrary can be demolished by a final court decision.
Since the day of the meeting until today, Friday, May 15, when the decision was made public, the contested provision was replaced by a new decision stating that only buildings which have been declared arbitrary by a court order can be demolished.
The case reached the Greek Council of State after three Athens residents sought to void the Ministerial decision on the launch of the information system for processing declarations on arbitrary buildings -included in the law- as unconstitutional and illegal.
