Egypt’s Supreme Court is expected to issue an important ruling on October 24 concerning the property rights and legal status of St. Catherine’s Monastery at Mount Sinai, as negotiations between the monastery and Egyptian authorities remain unresolved.

Τhe court is considering appeals filed by both the monastery and the Egyptian government against an earlier ruling by the Ismailia Court of Appeal.

Recommendations submitted by prosecutors reportedly reject the monastery’s principal argument for acquiring ownership through adverse possession while partially supporting the Egyptian state’s appeal.

The recommendations, if adopted by the court, could result in the monastery losing additional properties.

Negotiations Remain Unresolved

Negotiations between the monastery and Egyptian authorities have continued for nearly ten months without a final agreement.

Α proposed settlement would secure the monastery’s continued operation, establish its legal personality under Egyptian law and provide a framework for its use of the disputed properties.

Abbot Symeon and the monastic community have not yet approved the agreement, amid objections attributed to former Abbot Damianos and ecclesiastical figures associated with Mount Athos.

The Greek government has been involved in discussions with Cairo, although the final decision on whether to accept the proposed settlement rests with the monastery.

Τhe Patriarchate of Jerusalem and the Ecumenical Patriarchate are prepared to support an agreement intended to safeguard the monastery’s continued operation.

Property Disputes and Legal Status

The dispute concerns the ownership of properties associated with the monastery and its legal standing within Egypt’s judicial system. Questions have also been raised about the handling of the monastery’s property claims under the previous administration.

Court records include statements by former Abbot Damianos acknowledging that the monastery occupied certain disputed properties for religious purposes without holding legal ownership.

The monastery’s status as a historic religious institution and archaeological site has complicated efforts to establish ownership rights under Egyptian law.

The ongoing negotiations seek to resolve these issues through an agreement that would recognize the monastery’s legal status and protect its religious activities.
