Greece First in Europe in Number of Pending Administrative Cases

Greece is in first place in the number of pending administrative cases among the 26 European Union member states, according to president of the Association of Administrative Judges (EDD) Eirini Giannadaki.
Giannadaki addressed the annual EDD meeting held by the Athens Bar, saying that lawsuits filed today in Administrative Courts take seven years to be resolved, as tax affairs are the top priority.
Specifically, Giannadaki said, the hearing of a lawsuit filed today in an Administrative Court, will be held in seven years as tax cases concerning the determination of financial damages are the main priority as a bailout program obligation.
“Our country is the first among 26 EU countries with the largest number of pending administrative cases because almost all of the state’s operational problems are basically transferred to the Administrative Justice,” Giannadaki said.
In Greek Administrative Courts there are currently 288,229 cases pending, of which 245,795 cases are pending in first instance courts and 42,434 in appeal courts.
Of the pending cases, 58,082 are tax related, while the remaining 230,147 cases are related to other issues.
In recent years, the EDD president said, 38 bills for speeding the administration of justice passed in Greek Parliament, but the problem is not solved, since the new legislation “did not touch the root of the problem.”
Furthermore, Giannadaki said, the cost of court fees has become unaffordable to debt-ridden Greeks, and as a result the majority of them avoid seeking justice in Greek courts.
“In the name of accelerating processes to cover the cash needs of its coffers, the state restricts (Greek citizens’) rights to judicial protection. The increasing costs of legal procedures along with the delay of trials, deters people from seeking justice in the Greek court system,” the EDD president said.
