Former Minister of Finance Taken to Special Court

PapakonstantinouThe Deputy Public Prosecutor of the Supreme Court Anastasios Kanellopoulos submitted his motion to the Judicial Council of the Special Court, which essentially proposes the committal of former Finance Minister Georgios Papaconstantinou for the case of tampering and concealment of the Lagarde list.
Mr. Kanellopoulos believes that the prosecution of Mr. Papakonstantinou for offenses of distorting a document, of infidelity and misconduct is legitimate and the time limit which entitles the Parliament for criminal prosecution has not yet expired.
The Deputy Public Prosecutor of the Supreme Court claims that in view of the fact that the Parliament came out of elections on the 6th of May 2012 and did not operate, therefore it was objectively impossible to exercise its responsibilities. That is, to attend to the case of former Minister of Finance to set up a parliamentary committee and then for the Parliament Assembly to prosecute him.
In his six-page motion Mr. Kanellopoulos justifies the lack of a prescription because as he claims The one-day Parliament didn’t last long enough. Therefore it was “physically” and “logically impossible for the Parliament to have two regular sessions each of which could not be shorter than five months.” Thus, the short time limit shall run until the end of the second regular session of the next period (i.e. the current Parliament).
