McDonald’s Sued for Cleaner’s Fall

images mcFast food giant McDonald’s has told an Adelaide court it should not be held responsible for an injury to a Greek-Australian cleaning woman who fell after she slipped on a liquid that had been spilled on an access entryway behind its facility at the Myer Centre outlet in Rundle Mall.

Zissis is suing McDonald’s and the building’s manager, Colonial First State Property Management, in South Australia’s District Court.

In court documents, she claimed she injured her neck, lower back and buttocks and has suffered headaches and psychological injuries which have deprived her since then the ability to live a normal life and return to full employment.

She said the liquid spillage was the result of negligence by McDonald’s staff and that both defendants failed to warn her of the hazard. Her husband, Angeloa, has joined his wife’s claim against the company. They deny the company’s claims that she was not wearing proper footwear when she fell and that she was at fault for not looking for hazards.

Colonial First State also denied it had a duty of care to Zissis and argued she was obliged to inspect and clean the area. It also stressed that the center had appropriate systems in place to deal with spills and her failure to stop and mop up the mess led to the incident. It also said that had only had a temporary injury and fully recovered.
