The High Court has cleared the way for accused killer Peter Dupas to seek a permanent stay of a new trial over the stabbing death of Mersina Halvagis.
Ms Halvagis’ family was in court for the decision, which gives her accused killer permission to fight his re-trial.
Dupas was found guilty of murdering Ms Halvagis in 2007, but the conviction was later overturned.
His lawyer said there should be a permanent stay on the retrial, arguing prejudicial media publicity would prevent his client from a fair trial.
Ms Halvagis, 25, was killed while visiting her grandmother’s grave at Fawkner cemetery in November 1997.
Dupas’ appeal hearing is likely to be heard in April.
